Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy ("Policy") supplements our Privacy Policy and is intended to provide additional transparency about how Forward Health (operated by Growth Engineer LLC) collects, uses, shares, and protects consumer health data, including for residents of states with specific consumer health data privacy laws, including but not limited to Washington State's My Health MY Data Act and other applicable state consumer health data laws.
1. What is consumer health data?
Consumer health data includes personal information that identifies or is reasonably linkable to a consumer and that is collected in connection with a consumer's physical or mental health status. This includes:
- Health conditions, diagnoses, or symptoms you describe in your intake
- Disability status or mobility limitations
- Medical history information you provide
- Information derived from the above that can be used to make inferences about your health
2. How we collect consumer health data
We collect consumer health data that you voluntarily provide when:
- Completing the medical intake form for your disability parking permit evaluation
- Communicating with our support team about your health-related needs
- Providing additional medical documentation at the physician's request
3. How we use consumer health data
We use your consumer health data only for the following purposes:
- To facilitate your telehealth evaluation with a licensed physician
- To generate and deliver your physician-signed DMV certification forms
- To communicate with you about your evaluation and forms
- To maintain medical records as required by applicable law
- To comply with legal obligations
We do not sell your consumer health data. We do not use your consumer health data for advertising targeting, profiling unrelated to healthcare, or any purpose inconsistent with the purposes listed above.
Analytics tools used on our platform (PostHog and Flock) are configured to mask sensitive form fields where possible, consistent with the disclosures in our Privacy Policy. These tools do not receive your health data for advertising or profiling purposes.
4. How we share consumer health data
We share your consumer health data only with:
- Licensed physicians who conduct your evaluation
- Service providers who assist in delivering the Service and who are contractually obligated to protect your data and use it only for specified purposes
- Legal authorities when required by law, court order, or valid legal process
5. Your rights
Subject to applicable law and certain exceptions, you may have the following rights regarding your consumer health data:
- Right to access: Request a copy of the consumer health data we hold about you
- Right to delete: Request deletion of your consumer health data, subject to legal retention requirements
- Right to withdraw consent: Withdraw consent to our collection or sharing of your consumer health data
- Right not to be discriminated against: We will not discriminate against you for exercising your privacy rights

6. Data security
We implement technical, administrative, and physical safeguards designed to protect consumer health data from unauthorized access, disclosure, or destruction. These include encrypted data transmission, access controls, and regular security reviews.
7. Data retention
We retain consumer health data for the period necessary to fulfill the purposes described in this Policy and to comply with applicable healthcare recordkeeping laws. Upon expiration of retention periods, we securely delete or de-identify consumer health data.
